Tax residency in Malaysia
An individual is tax resident in Malaysia for a year of assessment (calendar year) if any of the following statutory presence tests is met: present in Malaysia for 182 days or more in the year; present for less than 182 days in the year where that period is linked to a period of at least 182 consecutive days in the immediately preceding or immediately following year, with certain temporary absences—service matters connected with employment in Malaysia, the individual’s illness, the illness of an immediate family member, or social visits not exceeding 14 days—treated as days in Malaysia provided the individual is in Malaysia immediately before and after the absence; present in Malaysia for at least 90 days in the year and present for at least 90 days or resident in any three of the four immediately preceding years; or resident in the year immediately preceding and the year immediately following the relevant year regardless of days in the relevant year. For day counting, any part of a day in Malaysia (including days of arrival and departure) is counted. Residence is determined by these statutory tests irrespective of citizenship or domicile; if dual residence arises, the applicable tax treaty tie‑breaker (typically considering permanent home, centre of vital interests, habitual abode, and nationality) determines treaty residence.
