Tax residency in Guernsey
For Guernsey (including Alderney and Herm), an individual is resident and principally resident for a calendar year if present in Guernsey for 183 days or more in that year, or if present for 91 days or more in that year and for at least 730 days in total in the four preceding years, or if the individual takes up permanent residence in Guernsey at any time in the year. An individual is resident (but not principally resident) if present in Guernsey for 91 days or more in the year without meeting a principally resident test, or if present for at least 35 days in the year and for an aggregate of 365 days in the four preceding years. An individual is not resident if present for fewer than 91 days in the year and none of the foregoing tests are met. Where an individual is resident in both Guernsey and another jurisdiction under domestic rules, any applicable double tax agreement determines treaty residence by tie‑breaker criteria applied in order, typically permanent home, centre of vital interests, habitual abode, nationality, and mutual agreement.
